An Unenforceable Contract is a legally valid agreement that the courts will not recognize or compel either party to perform, often because it violates public policy, lacks proper legal form, or is otherwise deemed contrary to law. In the hormonal health and wellness domain, a service contract may be deemed unenforceable if it contains illegal provisions, such as waiving a provider’s liability for gross negligence or promising guaranteed medical outcomes that are scientifically impossible or misleading. It is a contract that cannot be legally remedied.
