In the context of health insurance and wellness-related litigation, a Subrogation Clause is a contractual provision that grants the insurance provider the legal right to recover funds they have paid out for a beneficiary’s medical treatment from a third party who is legally responsible for the injury or illness. For example, if an individual’s hormonal disorder is proven to be caused by a defective supplement or a documented environmental endocrine disruptor, the insurer can seek reimbursement from the manufacturer or polluter. This clause is a mechanism for cost recovery within the healthcare system.
