Legal Definition of Voluntary

Meaning

The legal definition of voluntary, particularly in the context of employer-sponsored wellness programs, refers to the requirement that an employee’s participation in a medical examination or health-related inquiry must be genuinely uncoerced and free from significant financial or employment-related pressure. Under the Americans with Disabilities Act (ADA) and the Genetic Information Nondiscrimination Act (GINA), a program is not considered voluntary if the incentive or penalty tied to participation is so substantial as to make non-participation an unreasonable financial choice for the employee.
