Meaning

The stringent legal standard established by the Americans with Disabilities Act (ADA) that must be met for an employer to mandate a medical examination or disability-related inquiry of an employee. This necessity is only established when the inquiry or examination is directly related to the specific job functions and is required to determine if the employee can perform the essential functions of the job safely, or to determine a reasonable accommodation. It serves as a high bar to prevent unnecessary intrusion into an individual’s private health status, including their hormonal balance.
