Incentive structure coercion describes a situation where the financial rewards offered for participation in a wellness program, or the penalties for non-participation, are so substantial that they effectively eliminate an individual’s free choice to decline a health-related activity, such as a medical examination or a biometric screen. In the context of hormonal health, this coercion could occur if the penalty for refusing a testosterone or thyroid panel is a significant increase in health insurance premiums, pressuring the employee to disclose sensitive physiological data. Legal statutes like the ADA and HIPAA place strict limits on incentives to prevent this form of economic duress and ensure genuine voluntariness in health decision-making.
