Meaning

Personal health information that is collected, used, or shared by commercial entities, such as wellness apps and direct-to-consumer testing companies, and is therefore subject to the oversight and enforcement authority of the Federal Trade Commission (FTC). Unlike data governed by HIPAA, this often includes non-traditional, consumer-generated physiological data like sleep patterns, activity levels, and self-reported hormonal symptoms. The FTC’s role is to ensure that these companies do not engage in unfair or deceptive practices regarding data privacy and security.
