Exculpatory Agreement

Meaning

An exculpatory agreement, or release of liability, is a legally binding contract between a service provider and a participant that attempts to absolve the provider from liability for injuries or damages that may occur during a specific activity or program. In the hormonal health and wellness context, this document is often used in conjunction with non-standard wellness protocols, intense fitness programs, or experimental nutraceutical regimens to delineate the known risks and the participant’s acceptance of those risks. This agreement does not typically shield a practitioner from gross negligence or intentional harm, but it establishes a clear boundary for ordinary negligence in a complex clinical setting. Its use emphasizes transparency and informed decision-making.
