EEOC Complaint

Meaning

An EEOC Complaint, or a charge filed with the Equal Employment Opportunity Commission, is a formal administrative action alleging that an employer has violated federal anti-discrimination laws. In the context of hormonal health and wellness programs, such a complaint may arise if an employee believes a wellness initiative discriminates against them based on a disability, such as a chronic endocrine disorder like diabetes or hypothyroidism, or due to genetic information. These complaints specifically challenge wellness programs that may impose coercive penalties or rewards, potentially making participation non-voluntary for individuals with certain health statuses. The process serves as a mandatory precursor to filing a federal lawsuit under statutes like the Americans with Disabilities Act (ADA) or the Genetic Information Nondiscrimination Act (GINA).
