Disparate Impact

Meaning

Disparate impact is a legal and ethical concept describing a policy or practice that, while appearing neutral and applied uniformly to all individuals, results in a disproportionately adverse effect on a protected group based on a non-discriminatory characteristic. In the context of hormonal health and workplace wellness, a seemingly neutral program requirement might inadvertently disadvantage individuals with chronic conditions or disabilities rooted in endocrine dysfunction. Recognizing disparate impact is crucial for ethical program design, ensuring that incentives or penalties do not unfairly penalize employees for health statuses that are medically difficult or impossible to change.
