Areas within the digital health and wellness ecosystem where existing governmental statutes and regulatory oversight mechanisms fail to adequately address the novel risks, technologies, or business models currently in use. These gaps often exist in the regulation of consumer-facing devices and apps that collect highly sensitive physiological data, such as hormonal cycle tracking or sleep data, without being classified as medical devices subject to strict FDA or HIPAA oversight. This lack of clear jurisdiction creates ambiguity regarding data privacy, clinical efficacy, and patient safety.
