Business Necessity is a stringent legal standard that allows an employer to mandate a medical examination or health inquiry, such as a physical fitness test or specific physiological screening, only if it is essential to an employee’s ability to perform the core functions of their job. This concept establishes a high evidentiary threshold, demanding that the health requirement be directly job-related and absolutely necessary for the safe and efficient operation of the business. In the wellness domain, a non-job-related hormonal health screen, for instance, would generally not satisfy this legal justification.
